Consultation and Prevention
The attorneys in our Employment Law Department frequently represent management in a myriad of issues facing employers today. Our attorneys provide advice to employers about all aspects of the employment relationship, including hiring, promotion, accommodation, discipline and termination. We will review and assist in implementing employee handbooks; provide training to prevent discrimination and harassment in the work place and assist in investigations where such claims are made; and provide advice and counsel on such issues as the North Dakota Human Rights Act, the Federal Civil Rights Act, the Americans with Disabilities Act, the Family Medical Leave Act and the Fair Labor Standards Act.
Representation in Litigation
Our lawyers have successfully defended employers in lawsuits involving claims of violations of covenants not to compete, discrimination, sexual harassment, wrongful termination, retaliation, wage and hour violations and violations under the ADA in state and federal courts in both Minnesota and North Dakota.
Education and Training
Our Employment Law group frequently provide employee training on a variety of issues including the prevention of sexual harassment and discrimination, wage and hour compliance, lawful terminations, reasonable accommodations within the ADA, leave provisions under the FMLA, as well as training for managers and supervisors.
Auditing and Risk Analysis
Our Employment lawyers also specialize and are well experienced in assisting employers of all sizes by reviewing handbooks, employment manuals and other employment policies; advising on such critical issues as hiring, discipline and firing; the performance evaluation process; layoffs and reductions in force.
